Advertising law for claims

Sales team1 min read

The Business Protection from Misleading Marketing Regulations 2008 (BPRs) and the CAP Code apply, and we meet the consumer standard too.

  1. Evidence before claims (CAP rule 3.7). Omissions can mislead too.
  2. No superlatives or unsourced comparisons: no "best", "most advanced", "only", "leading" (CAP rules 3.32 to 3.34; BPRs regulation 4).
  3. The deadline never moves (CAP rule 8.17.4.e).
  4. Counters only from billing: a wrong seats-left figure misleads even when caused by error (CAP rule 3.31; ASA ruling, Uppholdings Ltd, 22 November 2023).
  5. No "was" price (CM13).
  6. Affiliates label "Ad": "Ad" at the start ("#Ad" on X). "Affiliate" on its own, "#collab", or a line at the end is not enough. Maktura cannot hand this responsibility to the partner (ASA affiliate marketing advice, 22 March 2023).
